2. Filing a Takedown Notice
If you believe content on FieldsHub infringes your copyright, please send our DMCA agent a written notice that includes all of the following (required by the DMCA):
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to be infringed (or, if multiple works are covered by a single notification, a representative list).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information sufficient for us to locate it (e.g., the URL or screenshot of the FieldsHub page).
- Information sufficient for us to contact you, including your address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
Notices that do not include all required elements may not be processed. Knowingly making material misrepresentations in a DMCA notice may expose you to liability for damages under 17 U.S.C. § 512(f).
3. How We Respond
Upon receipt of a properly filed notice, we will:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user who posted the material of the removal and provide a copy of the takedown notice, including your name and contact information.
- Inform the user of their right to file a counter-notification.
4. Counter-Notification
If you are a FieldsHub user and your content was removed in response to a DMCA takedown notice you believe was filed in error, you may submit a counter-notification. To be valid under the DMCA, your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, the federal district court in any judicial district where FieldsHub may be found), and that you will accept service of process from the original complainant or its agent.
If we receive a valid counter-notification, we will forward it to the original complainant. Unless the complainant files a court action seeking a restraining order against the user, we will restore the removed material in 10–14 business days.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, FieldsHub maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users determined to be repeat infringers. We may also limit access to the Service or terminate accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Modifications
We may update this DMCA Policy from time to time. The current version will always be posted at this URL. Material changes will be communicated to active users by email.
