Terms of Service

1. Acceptance of Terms
By accessing or using FieldsHub (the "Service"), a product of Beewist ("Beewist," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users including administrators, managers, workers (employees and subcontractors), accountants, and homeowner/customer-portal users. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
FieldsHub is a cloud-based construction management platform that provides tools for project management, estimating, invoicing, time tracking, GPS clock-in, expense management, scheduling, inventory and equipment tracking, safety reporting, and related operations for contractors and construction professionals.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials and any actions taken under your account.
- You must be at least 18 years old to create an account.
- One person or organization may not maintain more than one free account.
- You must notify us immediately of any unauthorized use of your account.
4. Subscription, Billing & Auto-Renewal
- Paid plans are billed monthly or annually as selected during checkout. Prices and plan terms are shown at the point of purchase.
- Auto-renewal: Subscriptions automatically renew at the end of each billing period at the then-current rate, charged to the payment method on file, until you cancel.
- Cancellation: You may cancel at any time from Settings → Billing. Cancellations take effect at the end of the current billing period; you retain access until then. We do not provide pro-rated refunds for partial periods unless required by law.
- California subscribers: You may cancel online at any time without contacting us, in compliance with California's Automatic Renewal Law. We will send a renewal reminder before each annual renewal.
- Free trials: Free trials automatically convert to paid subscriptions at the end of the trial unless you cancel before the trial ends. We will remind you before the trial converts.
- Price changes: We may change subscription pricing with at least 30 days' advance notice. The new price applies to billing periods starting after the notice period.
- Failed payments: If a payment fails, we may suspend access until payment is resolved. After 14 days of non-payment, we may downgrade or close the account.
- Add-on credits: AI and SMS credits are consumed as used and do not roll over between billing periods. Unused credits are non-refundable.
- Taxes: Fees do not include taxes; you are responsible for applicable sales, use, VAT, or similar taxes.
- Payments are processed by Stripe, Inc. By providing payment information you also agree to Stripe's terms.
4a. Online Payments & Chargeback Liability (FieldsHub Pay)
FieldsHub offers an optional service ("FieldsHub Pay", powered by Stripe Connect) that allows your customers to pay your invoices online via credit card or ACH bank transfer. By enabling FieldsHub Pay for your organization, you agree to the following terms in additionto the rest of these Terms and to Stripe's Connected Account Agreement.
- Platform fee: FieldsHub charges a platform fee on each successfully processed payment. The current default is 1.0% of the transaction; the fee is shown in your Settings → Payments page and may be different for your organization. Stripe's processing fees are charged separately by Stripe (typically 2.9% + $0.30 for cards, 0.8% capped at $5 for ACH).
- You are responsible for chargebacks and disputes: If a customer disputes or reverses a charge for any reason — including fraud, "item not as described", dissatisfaction with work, or unauthorized use of a payment method — the disputed amount, plus any chargeback fee assessed by the card network or the customer's bank, is your liability. Stripe will deduct disputed amounts from your Connected Account balance automatically.
- Right of recovery: If your Connected Account balance is insufficient to cover a chargeback or other negative balance, you authorize FieldsHub to (a) withhold from your future payouts until the negative balance is resolved, (b) extend your payout delay period, (c) debit funds from any payout method on file with Stripe to the maximum extent permitted by Stripe's Connected Account Agreement, and (d) invoice you for any unrecovered amount, payable within 30 days.
- Payout delays: You authorize FieldsHub to set your Stripe payout schedule to a default delay of 14 days on every transaction. This delay protects both you and FieldsHub from chargeback losses. FieldsHub may extend this delay temporarily or permanently (up to 31 days, the Stripe maximum) if your dispute rate is elevated, your business model changes, or other risk signals are detected.
- Suspension & termination of FieldsHub Pay: FieldsHub may suspend or terminate your access to FieldsHub Pay at any time if your dispute rate exceeds 1% of total transactions in any rolling 30-day period, if Stripe restricts your Connected Account, or if FieldsHub determines in its reasonable judgment that continuing to process payments for you presents unacceptable risk. You will retain access to all other FieldsHub services during any such suspension.
- KYC and identity verification: Stripe requires you to complete know-your- customer verification (legal entity, beneficial owners, business address, bank account, etc.) before payments can flow. You agree to provide accurate, complete, and up-to-date information, and to keep it current.
- Customer communication: You are solely responsible for the underlying work you bill your customers for. You agree to maintain accurate records (estimates, change orders, daily logs, photos, customer approvals) within FieldsHub to support dispute evidence submission. FieldsHub may use this data on your behalf when responding to disputes.
- Tax reporting: Where required, Stripe will issue you a Form 1099-K for payments processed through FieldsHub Pay. You are responsible for reporting and remitting taxes on the income.
5. SMS Messaging Consent (TCPA / A2P 10DLC)
By providing your mobile number — either by registering for FieldsHub directly or by being invited to an organization on FieldsHub by an administrator who provides your number — you consent to receive SMS messages from FieldsHub including: login verification codes (OTP), team-member invitation links, account-security alerts, billing and invoice notifications, and operational notifications such as schedule updates and customer-approval requests for estimates and change orders.
Message frequency varies based on account activity. Typical accounts receive a few to several dozen messages per month. Message and data rates may apply based on your wireless carrier's plan.
Opting out. Reply STOP to any FieldsHub SMS message to stop non-essential messages from that number. Reply HELP for support. Reply START to re-subscribe after opting out. Opting out of authentication messages (such as login codes) may prevent you from logging in.
No sharing for marketing. Mobile phone numbers, SMS opt-in records, and SMS messaging consent data are not shared, sold, leased, or otherwise transferred to third parties or affiliates for marketing or promotional purposes. SMS delivery is performed by Twilio, Inc., our messaging service provider, who is contractually prohibited from using this information for any purpose other than delivering messages on our behalf. 6. GPS / Worker Tracking
The Service includes optional GPS clock-in and crew-location features. If you are an employer or hiring contractor, you represent and warrant that, before enabling GPS tracking or geofencing for any worker, you have:
- Provided clear written notice to the worker of the monitoring;
- Obtained any consents required by applicable federal, state, or local law (including, where applicable, Illinois, New York, California, Connecticut, Delaware, New Jersey, Tennessee, and similar laws); and
- Used the data only for legitimate business purposes such as attendance, payroll verification, and site safety.
You agree to defend and indemnify FieldsHub against any third-party claim arising from your failure to provide such notice or obtain such consents.
7. Acceptable Use
You agree not to (and not to permit any user to):
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorized access to any account, system, or data
- Interfere with or disrupt the integrity or performance of the Service
- Upload malicious code, viruses, or harmful content
- Use the Service to send spam, phishing messages, or unsolicited communications
- Resell, sublicense, or redistribute the Service without our written consent
- Scrape, data-mine, or extract data from the Service via automated means
- Reverse-engineer or attempt to derive source code, except as permitted by law
- Use the Service to misclassify workers, evade wage-and-hour laws, or violate workplace-safety regulations

8. Your Data
- You retain ownership of all data you upload or create within the Service.
- You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, and display your data solely as needed to provide the Service.
- You are responsible for the accuracy, legality, and quality of your data.
- You are responsible for maintaining backups via our export tools.
- We will not access your data except as needed to provide support, maintain the Service, prevent fraud or abuse, or comply with legal obligations.
- Our handling of personal information is described in our Privacy Policy and Data Processing Addendum.
9. AI Features & Outputs
The Service includes AI-assisted features powered by the FieldsHub AI: the AI Estimate Wizard, Photo Analysis, Receipt Scanning, the Permit Review Assistant, and the AI chat helper. Each feature only processes the specific content you submit for that request — for example, the project description and scope you type into the estimate wizard, or the receipt image you upload to the receipt scanner.
FieldsHub AI does not process sensitive account data. We do not forward your customers' names, addresses, email addresses, phone numbers, payment information, banking details, employee records, or other sensitive account data to our AI. The AI only sees what you specifically type or upload for the request.
Submitted content is deleted immediately after the response is returned. Text and images you submit are processed in memory only for the duration of that single request, then discarded. They are not retained, used to train any model, or made available to any other user. Each request is stateless — the AI has no memory of previous prompts, photos, or other content from earlier sessions.
What we save in your account. The structured output the AI returns (line items of a generated estimate, extracted merchant/total/date from a scanned receipt, tagged analysis of a job-site photo) is stored in your FieldsHub account so you can review, edit, and use it. You can delete these outputs at any time using the same controls you use for any other record.
AI outputs are non-binding suggestions and may contain errors. You are solely responsible for reviewing, verifying, and editing AI-generated content before relying on it, sending it to a customer, or using it in any binding way. FieldsHub disclaims any warranty as to the accuracy, completeness, or fitness for purpose of AI outputs. AI features consume credits from your account balance.
10. Intellectual Property
FieldsHub is a product of Beewist LLC. The Service — including all software, source code, design, user interface, logos, branding, documentation, and trademarks — is the exclusive property of Beewist LLC and its licensors and is protected by U.S. and international copyright, trademark, trade secret, and other intellectual property laws.
Trademarks: "FieldsHub", "FieldsHub™", the FieldsHub hexagonal mark, and "Beewist" are trademarks of Beewist LLC. You may not use these marks without our prior written consent, except for nominative fair use to refer to our Service. Unauthorized use of our trademarks — including in domain names, social handles, or product names — may constitute infringement.
License grant to you: Subject to your compliance with these Terms and your payment of applicable fees, Beewist grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal business purposes during your subscription term. All rights not expressly granted are reserved.
Restrictions: You may not copy, modify, reverse engineer, decompile, create derivative works of, sell, sublicense, or use the Service to develop a competing product. You may not remove or alter any proprietary notices on the Service.
Your data: You retain all rights to data you input into the Service. You grant Beewist a limited license to host, store, and process your data solely to provide the Service.
Feedback: If you provide suggestions or feedback, you grant us a perpetual, royalty-free, worldwide license to use it to improve the Service without obligation to you.
11. DMCA / Copyright Complaints
If you believe content stored or transmitted via the Service infringes your copyright, please send a notice that includes:
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and its location
- Your contact information
- A statement that you have a good-faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act
- Your physical or electronic signature
Send notices to: dmca@beewist.com. We will respond per the DMCA, including by removing content and notifying the user who uploaded it.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUTS WILL BE ACCURATE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDSHUB AND BEEWIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.
14. Indemnification
You agree to defend, indemnify, and hold harmless FieldsHub, Beewist, and our officers, directors, employees, and agents from any claim, loss, liability, expense, or damages arising from: (a) your use of the Service; (b) your violation of these Terms or applicable law; (c) your data or content; or (d) your violation of any rights of a third party (including failure to provide required notice or obtain consent for worker monitoring).
15. Termination
You may cancel your subscription at any time. We may suspend or terminate your access for material breach of these Terms, non-payment, or to comply with law, with notice when practical. Upon termination your right to use the Service ends immediately. We will retain your data for up to 90 days after termination to allow export, after which it will be deleted unless legally required to retain. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, governing law) will survive.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in Albuquerque, New Mexico, or at a mutually agreed location.
Class action waiver: To the extent permitted by law, you and FieldsHub agree that each may bring claims only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
30-day opt-out: You may opt out of arbitration by emailing legal@beewist.com within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out."
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.
17. Changes to Terms
We may modify these Terms from time to time. For material changes, we will provide at least 30 days' advance notice via email or in-app notice. Your continued use after the effective date constitutes acceptance of the revised Terms.
18. Miscellaneous
- Entire agreement: These Terms (together with the Privacy Policy and any DPA) constitute the entire agreement between you and FieldsHub.
- Severability: If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver: Our failure to enforce any right is not a waiver of that right.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure: Neither party is liable for delays or failures due to causes beyond reasonable control.
- Notices: We may provide notices via email or in-app. You may send legal notices to legal@beewist.com.
